Boakai’s Refusal to Uphold S/Court’s Ruling Could have Global Repercussions | News

Former Grand Bassa County Representative Vicent Wille expressed concern over President Boakai’s failure to acknowledge Fonati Koffa as the legitimate Speaker of the House, stating that such actions could have repercussions for Liberia’s democracy and international reputation.

“We must all realise that Boakai’s refusal to uphold the rulings of the Supreme Court carries profound implications for constitutional governance, civic engagement, and international reputation.” He said in a post on Facebook. “This is not only out of place but also undermines Liberia’s democracy,” Willie said. 

Wille emphasized the importance of upholding Supreme Court rulings for constitutional governance and civic engagement. He highlighted the potential risks associated with disregarding judicial authority, including threats to the balance of power between state institutions and the stability of Liberia’s democracy. 

Willie said the action of the President reflects a power struggle, threatens the delicate balance between state institutions, and poses significant risks to Liberia’s stability and democratic aspirations. 

He said as the country continues to navigate the complexities of governance after years of conflict, adherence to the rule of law and respect for judicial authority remains critical for fostering a functional democracy and a cohesive society. 

“The long-term stability of Liberia will heavily depend on the commitment of President Boakai’s leadership to uphold constitutional principles and engage in constructive dialogue that respects the roles of all branches of government. The Supreme Court of Liberia is crucial in interpreting the Constitution and upholding the rule of law.” The former lawmaker wrote.  

He called on President Boakai and his Rescue Team to cease hiding behind the phrase “the government must function, and we must do the Liberian people’s work” and begin taking genuine steps toward exercising leadership while considering the balance of power and coordination. “When a president refuses to uphold rulings made by the Supreme Court, it signifies a blatant violation of our Constitution. It also threatens the fundamental principle of separation of powers, undermining the judiciary’s authority and creating an environment where executive power may dominate, potentially leading to authoritarian tendencies. As a man with over 40 years of experience in government (The Rescuers Campaign Slogan), President Boakai must have been aware of the impact of erosion on judicial independence.” 

According to him, when executive power disregards the judicial branch, it undermines the judicial system’s integrity, and Liberians may view the courts as extensions of the government rather than as independent entities. 

The former Grand Bassa lawmaker mentioned that said action from the president can erode public trust in the judicial system, leading individuals to seek alternative dispute-resolution mechanisms. 

“Refusing to adhere to Supreme Court rulings can also exacerbate political tensions among various groups and parties; as our country recovers from civil war, such actions by the President risk rekindling old animosities and fueling grievances, which could ultimately lead to conflicts.”

He said as the nation moves to 2029 “President Boakai, who openly disregards judicial authority”, has created an environment of rampant corruption and bad governance. “Simultaneously, government officials might manipulate laws to serve their interests in preserving state power. However, these tactics of the UP Government have led to poor public service delivery and a lack of accountability, further exacerbating poverty and inequality. Citizens feel uneasy upon observing their president defy the judicial system.” 

“This disillusionment can breed apathy and result in low voter turnout in future elections, undermining democratic processes and the legitimacy of government institutions. In contrast, the government employs similar strategies to maintain its grip on state power.”

Liberia’s International Reputation

The former lawmaker claimed that the President’s alleged disregard for the Supreme Court can significantly tarnish Liberia’s international reputation, particularly among Western nations prioritizing human rights, democracy, and the rule of law. 

“Our foreign partners may perceive Liberia as regressing into autocracy, jeopardising foreign investment and aid. Non-governmental organisations and international bodies that promote democracy may reconsider their engagements with Liberia if the situation appears to worsen.”

According to him, this action could lead to reduced funding and support for democratic governance and developmental initiatives as the government struggles with international backing. 

“This signals to other leaders that undermining judicial independence could be politically viable, potentially resulting in greater democratic regression across the region. As such, organizations like the UN and ECOWAS may intensify monitoring efforts and issue statements regarding Liberia’s adherence to judicial rulings and democratic norms.” He noted. 

Wille urged President Boakai to prioritize adherence to the rule of law, engage in constructive dialogue, and respect the roles of all branches of government to maintain the country’s long-term stability

He also warned that undermining judicial independence could erode public trust, exacerbate political tensions, and harm Liberia’s international standing, potentially leading to reduced foreign investment and aid.

Wille called for a commitment to democratic norms and constructive engagement with international partners to safeguard Liberia’s reputation and ensure adherence to judicial rulings.
